1. Acceptance of Terms By accessing our website, enrolling in any program, or participating in any activity at Heimberger's Martial Arts, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree, please do not use our website or services.
2. Business Identity JHOON RHEE INSTITUTE, INC. D/B/A Heimberger's Martial Arts is a martial arts training facility located at 1836 Bruce B Downs Blvd, Wesley Chapel, FL 33544. We offer in-person martial arts instruction and training programs for students ages 4 and up. By opting into our SMS program you may receive messages related to class schedules, appointment reminders, enrollment updates, special offers, and other important updates.
3. Services Offered Heimberger's Martial Arts offers in-person martial arts instruction and training programs at our Wesley Chapel, Florida location. We do not offer online classes. Equipment purchases are required for participation per insurance regulations and are final and non-refundable. Programs and class schedules are subject to change at the discretion of the Institute.
4. Enrollment & Program Terms Program-specific terms, conditions, and durations vary by program. Please consult a Program Director for full details regarding the specific program you are enrolling in. All enrollment agreements are governed by the terms outlined in your signed enrollment contract with JHOON RHEE INSTITUTE, INC. D/B/A Heimberger's Martial Arts
5. Free Trial A free trial class is available to prospective students. All participants including free trial participants must execute a signed Participant Waiver, Release of Liability, Indemnity, and Assumption of Risk Agreement prior to entering the dojo or participating in any activity.
6. Paid Trial Period A one-month paid trial program is available for new students. All fees paid for the one-month trial are non-refundable and non-exchangeable. No exceptions will be made.
7. Safety Equipment For the safety of all students and as required by our insurance regulations, all participants are required to purchase and use approved safety equipment as specified by the Institute prior to participating in contact activities. Safety equipment requirements vary by program and age group. Please consult a Program Director for specific equipment requirements for your program. Equipment purchases are final and non-refundable.
8. Non-Transferability Enrollment agreements and memberships are non-transferable without the express written consent of JHOON RHEE INSTITUTE, INC. D/B/A Heimberger's Martial Arts.
9. Minor Participants Students under the age of 18 must have a parent or legal guardian execute all required agreements, including the Participant Waiver, Release of Liability, Indemnity, and Assumption of Risk Agreement, prior to participation. By executing these agreements, the parent or guardian represents they have the legal authority to do so on behalf of the minor.
10. Waiver & Release of Liability All participants are required to sign a Participant Waiver, Release of Liability, Indemnity, and Assumption of Risk Agreement prior to participating in any activity. Participation in martial arts involves inherent risks including but not limited to physical injury. By participating, you acknowledge and assume all such risks.
11. SMS / Text Message Communications By providing your phone number on our website contact form or during enrollment, you consent to receive text messages from JHOON RHEE INSTITUTE, INC. D/B/A Heimberger's Martial Arts at 813-733-5338 regarding your inquiry, class schedules, appointment reminders, promotional offers, and other important updates.

12. Opt-Out & Support You can cancel SMS service at any time. Just text STOP to 813-733-5338. After you send the SMS message STOP to us, we will send you an SMS message to confirm that you have been unsubscribed. After this you will no longer receive SMS messages from us. If you want to join again just sign up as you did the first time and we will start sending SMS messages to you again.

13. Message Frequency & Rates Message and data rates may apply for any messages sent to you from us and to us from you. You will receive up to 5 messages per enrollment interaction and message frequency may vary based on program participation. If you have any questions about your text plan or data plan it is best to contact your wireless provider.
14. Carrier Liability Carriers are not liable for delayed or undelivered messages.

16. Media Release By participating in activities at Heimberger's Martial Arts, participants grant the Institute the right to use photographs, videos, and other media captured on premises for promotional, advertising, and marketing purposes including website and social media use, consistent with the signed Participant Waiver.
17. Dispute Resolution Any disputes arising from enrollment or participation shall first be submitted to mediation. If mediation is unsuccessful, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association (AAA), conducted in Pasco County, Florida. The parties waive their right to a trial by jury.
18. Governing Law These Terms of Service shall be governed by and construed in accordance with the laws of the State of Florida. Any legal action shall be brought exclusively in the state or federal courts located in Pasco County, Florida.
19. Severability If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
20. Modifications Heimberger's Martial Arts reserves the right to modify these Terms of Service at any time. Updates will be posted on our website. Continued use of our services following any modification constitutes acceptance of the revised terms.
21. Age Restriction You must be 18 years or older to participate in our SMS messaging program. By opting in to receive SMS messages you represent that you are at least 18 years of age. Parents or legal guardians who enroll minor students are responsible for ensuring they meet this requirement on behalf of the minor.
22. Supported Carriers Our SMS program works with all major U.S. wireless carriers including AT&T, T-Mobile, Verizon, Sprint, and most regional carriers. Carrier support may vary.
23. Intellectual Property Rights This Site and all materials available on the Site are the property of JHOON RHEE INSTITUTE, INC. D/B/A Heimberger's Martial Arts and are protected by copyright, trademark, and other intellectual property laws. You may not modify, copy, reproduce, republish, upload, post, transmit, sell, or distribute any material from the Site without our express written permission. You may download or print one copy of individual pages for personal non-commercial use provided all copyright and proprietary notices remain intact.
By submitting any material to us via the Site including photos or videos you represent that you own the material or have obtained necessary permissions and grant us a royalty-free, perpetual, irrevocable, non-exclusive worldwide license to use, modify, distribute, and publicly display such material.
24. Disclaimers The information, products, and services offered on or through the Site are provided as-is and without warranties of any kind either express or implied. To the fullest extent permissible pursuant to applicable law we disclaim all warranties including implied warranties of merchantability and fitness for a particular purpose.

25. Indemnification You agree to indemnify and hold harmless JHOON RHEE INSTITUTE, INC. D/B/A Heimberger's Martial Arts, its affiliates, officers, directors, agents, and employees from any claims, causes of action, damages, liabilities, costs, and expenses arising out of or related to your breach of any obligation, warranty, or representation under these Terms of Service.
26. Termination We reserve the right to terminate or suspend your access to the Site without notice if we determine that you have violated these Terms of Service or engaged in conduct that we deem inappropriate or unlawful. Upon termination you must cease all use of the Site and any content obtained from it.
