1. Acceptance of Terms By accessing our website, enrolling in any program, or participating in any activity at Heimberger's Martial Arts, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree, please do not use our website or services.
2. Services Offered Heimberger's Martial Arts offers in-person martial arts instruction and training programs for students ages 4 and up at our Wesley Chapel, Florida location. We do not offer online classes. Programs and class schedules are subject to change at the discretion of the Institute.
3. Enrollment & Program Terms Program-specific terms, conditions, and durations vary by program. Please consult a Program Director for full details regarding the specific program you are enrolling in. All enrollment agreements are governed by the terms outlined in your signed enrollment contract with JHOON RHEE INSTITUTE, INC.
4. Free Trial A free trial class is available to prospective students. All participants, including free trial participants, must execute a signed Participant Waiver, Release of Liability, Indemnity, and Assumption of Risk Agreement prior to entering the dojo or participating in any activity.
5. Paid Trial Period A one-month paid trial program is available for new students. All fees paid for the one-month trial are non-refundable and non-exchangeable. No exceptions will be made.
6. Tuition & Payment Tuition rates and payment terms are outlined in your individual enrollment contract. Unpaid balances may be subject to late fees as specified in your contract. The Institute reserves the right to modify tuition rates with appropriate notice.
7. Safety Equipment For the safety of all students and as required by our insurance regulations, all participants are required to purchase and use approved safety equipment as specified by the Institute. Equipment purchases are final and non-refundable.
8. Non-Transferability Enrollment agreements and memberships are non-transferable without the express written consent of JHOON RHEE INSTITUTE, INC.
9. Minor Participants Students under the age of 18 must have a parent or legal guardian execute all required agreements, including the Participant Waiver, Release of Liability, Indemnity, and Assumption of Risk Agreement, prior to participation. By executing these agreements, the parent or guardian represents they have the legal authority to do so on behalf of the minor.
10. Waiver & Release of Liability All participants are required to sign a Participant Waiver, Release of Liability, Indemnity, and Assumption of Risk Agreement prior to participating in any activity. Participation in martial arts involves inherent risks including but not limited to physical injury. By participating, you acknowledge and assume all such risks.
11. SMS / Text Message Communications By providing your phone number on our website contact form or during enrollment, you consent to receive text messages from Heimberger's Martial Arts regarding your inquiry, class schedules, appointment reminders, promotional offers, and other important updates.

12. Media Release By participating in activities at Heimberger's Martial Arts, participants grant the Institute the right to use photographs, videos, and other media captured on premises for promotional, advertising, and marketing purposes including website and social media use, consistent with the signed Participant Waiver.
13. Dispute Resolution Any disputes arising from enrollment or participation shall first be submitted to mediation. If mediation is unsuccessful, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association (AAA), conducted in Pasco County, Florida. The parties waive their right to a trial by jury.
14. Governing Law These Terms of Service shall be governed by and construed in accordance with the laws of the State of Florida. Any legal action shall be brought exclusively in the state or federal courts located in Pasco County, Florida.
15. Severability If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
16. Modifications Heimberger's Martial Arts reserves the right to modify these Terms of Service at any time. Updates will be posted on our website. Continued use of our services following any modification constitutes acceptance of the revised terms.
